By purchasing, installing, or using our products and services, you agree to the following terms and conditions.
1. Definitions
- "Company" refers to Jawabu Tracking Limited.
- "Customer" refers to any individual or organization purchasing products or services from the Company.
- "Products" refer to all tracking devices and accessories sold by the Company.
- "Services" refer to installation, monitoring, fleet management, support, and subscription-based services provided by the Company.
2. Product Purchase & Ownership
All purchases are considered complete upon full payment.
The purchase price covers the device, installation, and initial setup.
3. Warranty & Tampering
All devices come with a 12-month warranty covering manufacturing defects, installation errors, and normal usage issues.
The Company is not responsible for damages caused by accidents, misuse, electrical faults, or external interference.
4. Installation & Transport
The quoted price covers device cost, transportation, and installation within agreed service areas.
Any special installation requests outside standard procedures may attract additional costs.
5. Subscription & Renewal
After the first year of use, customers must pay an annual or monthly subscription fee to maintain service continuity.
6. Service Availability & Limitations
Jawabu Tracking provides 24/7 support for all customers.
While we strive for uninterrupted service, the Company cannot be held liable for interruptions caused by:
- Network failures (mobile, internet, or satellite)
- Power outages
- Force majeure events (theft, accidents, natural disasters, etc.)
Tracking accuracy depends on GPS and mobile network coverage.
7. Customer Responsibilities
- Customers must provide accurate vehicle and contact information during registration.
- Customers are responsible for ensuring timely subscription renewal.
- Customers must not attempt to alter, reconfigure, or uninstall devices without written approval from the Company.
- Customers should report any technical issues promptly to ensure optimal service.
8. Liability Disclaimer
The Company provides products and services to enhance security but does not guarantee theft prevention or recovery in all circumstances.
The Company shall not be liable for:
- Losses caused by customer negligence or non-compliance
- Damages arising from delayed reporting of incidents
- Third-party misuse of data or unauthorized access
- Consequential or indirect damages of any kind
9. Data Protection & Privacy
Customer data (location, vehicle details, personal information) is collected and stored securely in compliance with applicable data protection laws.
Data is only shared with the customer and authorized third parties (e.g., law enforcement) upon legitimate request.
Customers have the right to request access to, correction of, or deletion of their personal data subject to legal and contractual obligations.
10. Payment Terms
All purchases must be paid in full before installation commences.
Subscription fees are due in advance and must be paid by the due date to avoid service interruption.
Late payment may result in service suspension and additional charges.
Refunds are considered on a case-by-case basis within 14 days of purchase, subject to device condition.
11. Termination of Services
The Company reserves the right to suspend or terminate services in cases of:
- Non-payment of subscription fees
- Fraudulent activity
- Violation of these terms
- Abusive behavior towards staff
Customers may terminate services with 30 days written notice. Early termination does not entitle customers to refunds of subscription fees already paid.
12. Force Majeure
The Company shall not be liable for any failure or delay in performance due to circumstances beyond its reasonable control, including but not limited to:
- Natural disasters, pandemics, or acts of God
- Government actions, sanctions, or regulatory changes
- Infrastructure failures or cyber attacks
- Labor disputes or supplier failures
13. Amendments
The Company reserves the right to modify these Terms & Conditions at any time.
Customers will be notified of significant changes via email or SMS at least 30 days in advance.
Continued use of services after changes take effect constitutes acceptance of the new terms.
14. Governing Law & Dispute Resolution
These Terms & Conditions are governed by the laws of Kenya.
Any disputes shall be settled through the following process:
- Direct negotiation between parties
- Mediation through a mutually agreed mediator
- Arbitration or Kenyan courts as a last resort
